1. Who we are and how to contact us

ScaleUp Marketing Co. (“ScaleUp Marketing Co.”, “we”, “us”, or “our”) operates the website at https://scaleupmarketingco.com and related services.

If you are in the European Economic Area, the United Kingdom, or Switzerland, ScaleUp Marketing Co. is the controller of your personal data for the purposes described in this Policy.

2. Information we collect

We collect information that you provide directly, information collected automatically, and information from third parties. These categories include:

  1. Contact and account information such as name, email address, phone number, company, job title, and any details you submit through forms, chats, or emails.
  2. Content you provide such as messages, support requests, survey responses, testimonials, or files you choose to upload.
  3. Transaction and inquiry details such as services requested, project notes, and related communications. We do not collect or store payment card numbers on our site. If a payment page is used, it is provided by a third party that processes the payment on our behalf.
  4. Technical and usage data such as IP address, device and browser type, operating system, referring and exit pages, pages viewed, links clicked, time spent, and approximate location derived from IP address.
  5. Cookies and similar technologies which record or infer preferences and usage. See Section 5 for more on cookies and choices.
  6. Third party data such as analytics and advertising data from providers including Google and Meta, as well as CRM and marketing automation data when you interact with our emails or forms.

3. How we use information

  1. Provide, operate, and improve the Services.
  2. Respond to inquiries, schedule calls, and deliver requested materials.
  3. Send service messages, marketing communications, and surveys consistent with your choices.
  4. Personalize content and measure the effectiveness of our marketing and advertising.
  5. Maintain security, prevent fraud, and diagnose or fix problems.
  6. Comply with legal obligations and enforce our terms.

Where GDPR applies, our legal bases include consent, performance of a contract or steps prior to a contract, compliance with legal obligations, and legitimate interests such as improving the Services and promoting our offerings in ways that respect your privacy.

4. Comments and media on our site

If comments are enabled and you leave a comment, we collect the data shown in the comment form along with the commenter’s IP address and browser user agent to help with spam detection. After approval of your comment, your profile image may be visible to the public in the context of your comment.

If you upload images, avoid including embedded location data. Visitors to the site can download and extract location data from images.

5. Cookies and similar technologies

Cookies are small files stored on your device that help the site function and help us understand how the site is used. We may also use pixels, tags, and local storage.

  1. Strictly necessary cookies support core features such as page navigation, form submissions, and security.

6. Sharing of information

  1. Service providers and vendors who perform services for us, such as website hosting, security, analytics, advertising, email delivery, CRM, and marketing automation.
  2. Business transfers in connection with a merger, acquisition, financing, or sale of assets.
  3. Legal and safety when required by law or to protect rights, property, users, or the public.

We do not sell personal information for money. Some advertising and analytics may be considered “sharing” for targeted advertising under certain US state privacy laws. See Section 10 to opt out.

7. Data retention

We keep information for as long as necessary to fulfill the purposes described in this Policy, including to comply with legal, accounting, or reporting requirements. Examples include:

  1. Contact form submissions, leads, and related communications are typically retained for up to 24 months unless a longer period is needed for ongoing business.
  2. Analytics data may be retained for up to 26 months depending on provider settings.
  3. Comments and associated metadata may be retained indefinitely to recognize and approve follow-up comments automatically.

8. International data transfers

We are based in the United States and may process information in the United States and other countries. If you are located outside the United States, your information may be transferred to a country that may not provide the same level of data protection as your home country. Where required, we use appropriate safeguards for transfers.

9. Security

We use administrative, technical, and physical safeguards designed to protect information against unauthorized access, loss, misuse, or alteration. No method of transmission or storage is fully secure, and we cannot guarantee absolute security.

10. Your privacy rights

Your rights depend on your location. You can exercise applicable rights by emailing brandon@scaleupmarketingco.com. We may need to verify your identity before responding.

EEA, UK, and Swiss individuals

You may have the right to request access, correction, deletion, restriction, portability, or to object to certain processing, including processing based on legitimate interests and direct marketing. Where we rely on consent, you can withdraw consent at any time.

California residents

You may have the right to request to know, access, correct, or delete personal information; to opt out of the sale or sharing of personal information for cross-context behavioral advertising; and to not be discriminated against for exercising your rights. To submit a request, email brandon@scaleupmarketingco.com with “California Privacy Request” in the subject. To opt out of sharing for targeted advertising, adjust your cookie preferences or email us with “Do Not Sell or Share My Personal Information” in the subject. You may designate an authorized agent to make a request on your behalf. We will take steps to verify the agent’s authority and your identity.

11. Do Not Track

Some browsers offer Do Not Track. We do not respond to Do Not Track signals. You can manage cookies and advertising preferences as described in Section 5.

12. Third party links and embedded content

The Services may include links to third party websites, plug-ins, and embedded content. Those third parties may collect information about you. Their practices are governed by their own privacy policies. We are not responsible for the privacy practices of third parties.

If you choose to use Gravatar for comments, the Gravatar service’s privacy policy applies. If you use social features or widgets, the provider’s policy applies.

13. Children’s privacy

The Services are not intended for children under the age of 13. If you are in the EEA, UK, or Switzerland, the Services are not intended for children under the age that requires parental consent for online services in your country. If we learn that we have collected personal information from a child without required consent, we will delete it.

14. Changes to this Policy

We may update this Policy from time to time. The “Last updated” date shows when changes were made. Material changes will be effective when posted, unless a different effective date is stated.
